MRC Webinar - Surcharging of Payments in the U.S.

Visa and MasterCard’s proposed settlement of an anti-trust class action case in the United States includes amendments to the Visa / MasterCard rules to permit merchants to surcharge customers based upon the payment method used.  A practice that has long been banned by payment network rules and only seen at the smallest of stores, surcharging may be something that merchants, merchant acquirers, and cardholders confront on a daily basis.

This webinar provides an introduction to surcharging and discusses the latest trends in surcharging in other markets around the world.  Subsequently, we discuss the proposed Visa and MasterCard settlement and explain what it means to merchants, both from a business and legal perspective, including walking through the proposed amendments to the Visa and MasterCard rules to permit surcharging.  Additionally, we discuss how the patchwork quilt of state laws, including outright prohibitions on surcharging in certain states, will impact merchants that are considering instituting surcharging in physical locations and online.  Finally, we conclude with a discussion of what this landscape means for merchants and lay out an approach merchants should consider when they are determining whether or not to surcharge.
