Litigation Support
Reviewed the policies and procedures for settling credit card transactions between a leading credit card processor and its member banks to establish clear lines of responsibility, revise or streamline procedures where necessary to produce more accurate and simpler reconciliation, and to reach agreement on outstanding settlement records. Reviewed marketing practices, including account acquisition and communications, operational issues relative to adverse action for a regional bank card issuer in support of expert testimony.
Prepared the damage assessment related to the litigation resulting from the co-brand partner's refusal to honor an established co-brand agreement. Damage assessment was based on the value of the portfolio just prior to an attempted sale compared to the actual value received at a later point in time. Assessed the competitive environment and management practices during the interim period to identify any changes in value related to other factors. Provided expert witness testimony in a jury trial that concluded in favor of damages for our client.
Provided expert witness litigation support for a class action lawsuit against a company's credit card portfolio due to under-reporting their credit losses to investors.
Developed a white paper on the evolution of consumer payment systems in the United States for a leading patent law firm that was used to support the prosecution of a patent infringement suit. The client successfully obtained a favorable verdict.
